| Resumo: | A pesquisa investiga o instituto jurídico chamado Investigação Preliminar, e a Figura do Juiz Investigador. Analiza-se para que se propõe e objetivos da investigação preliminar, bem como seu conceito e natureza jurídica. Aponta como o instituto se materializa no Brasil, através do inquérito policial, bem como as diferenças entre o inquérito policial e judicial. Outrossim, analisa a figura do juiz investigador, bem como as maneiras como ele já foi adotado no Brasil: A exemplo do inquérito judicial da Lei de Falências, e o do inquérito 4781 (Inquérito das fake news). | Abstract: | The research investigates the legal institute called Preliminary Investigation, and the Figure of the Investigating Judge. The purpose and objectives of the preliminary investigation are analyzed, as well as its concept and legal nature. It points out how the institute materializes in Brazil, through the police investigation, as well as the differences between the police and judicial investigation. Furthermore, it analyzes the figure of the investigating judge, as well as the ways in which it has already been adopted in Brazil: For example, the judicial inquiry into the Bankruptcy Law, and the inquiry 4781 (Fake news inquiry). This is as a way of analyzing its (in)compatibility with the accusatory system |
