O inquérito policial e a figura do juiz investigador

Abstract

The research investigates the legal institute called Preliminary Investigation, and the Figure of the Investigating Judge. The purpose and objectives of the preliminary investigation are analyzed, as well as its concept and legal nature. It points out how the institute materializes in Brazil, through the police investigation, as well as the differences between the police and judicial investigation. Furthermore, it analyzes the figure of the investigating judge, as well as the ways in which it has already been adopted in Brazil: For example, the judicial inquiry into the Bankruptcy Law, and the inquiry 4781 (Fake news inquiry). This is as a way of analyzing its (in)compatibility with the accusatory system
