A crise na Venezuela e a integração do refugiado no Brasil: o papel do Estado na efetivação dos direitos fundamentais

Abstract

The monograph addresses the humanitarian issue of welcoming refugees and their integration in Brazil, especially in the legal sphere, from a constitutional perspective. The significant increase in the number of refugees seeking shelter in national territory is due to the humanitarian crisis in Venezuela that has been accentuated in the last decade due to the government of Hugo Chávez and his successor Nicolás Maduro. Dealing with the arrival of a significant percentage of foreigners, Brazil has laws and decrees that seek to meet their needs, especially in regard to guaranteeing and enforcing fundamental rights provided by the Constitution. In the end, the topic is discussed in a specific case based on the analysis of the Brazilian Superior Court (STF) decision that denied the request to close borders between Brazil and Venezuela in ACO number 3.121
