| metadata.dc.description.resumo: | Assim, o presente estudo tem por finalidade identificar quais são os dispositivos legais que fundamentam o direito à vida e a autonomia da vontade no ordenamento jurídico brasileiro, bem como analisar a existência de possíveis fundamentos que seriam capazes de sustentar a eutanásia frente ao ordenamento brasileiro e por fim verificar se há a possibilidade de a eutanásia se alinhar junto a dignidade da pessoa humana e, portanto, ser um objeto da liberdade/vontade do sujeito de direitos. Portanto, em primeiro momento o presente estudo analisa o que são os direitos humanos e a dignidade da pessoa humana e, esclarece qual é o fundamento de cada um. Além disso, esclarece também a ligação entre a dignidade da pessoa humana e os direitos humanos, bem como trata sobre a positivação da dignidade da pessoa humana na constituição federal de 1988. |
| Resumen : | Thus, the present study aims to identify which devices are laws that underlie the right to life and the autonomy of the will in the legal Brazilian legal system, as well as analyzing the existence of possible foundations that would be able to support euthanasia in the face of the Brazilian legal system and finally verify if there is a possibility of euthanasia aligning itself with the dignity of the person human and, therefore, to be an object of the freedom/will of the subject of rights. Therefore, at first the present study analyzes what are the rights human beings and the dignity of the human person and clarifies what is the basis of each one. Furthermore, it also clarifies the link between the dignity of the human person and the human rights, as well as it deals with the affirmation of the dignity of the person human rights in the 1988 federal constitution. |
